Here’s a sample of what occurred on this day in the Lincoln conspiracy trial:

  • The final five witnesses of the trial testified including more perjured testimony
  • An 1864 advertisement offering to kill Lincoln, Seward, and Johnson for $1,000,000 was entered into evidence
  • The government presented their argument defending the use of a military trial
  • Mary Surratt was still too sick to attend the court today and so she stayed behind a closed door in her makeshift cell next to the courtroom

The Trial Today: June 26

Here’s a sample of what occurred on this day in the Lincoln conspiracy trial:

  • The court did not meet in order to allow the prosecution time to finish their closing arguments
  • Gen. Lew Wallace, of the commission, wrote to his wife on this date that he expected, “Three, if not four, of the eight will be acquitted”
  • Today, I show the sketches Lew Wallace made of the conspirators while in the courtroom like the one pictured above.
  • Six of David Herold’s sisters visited with their brother in the empty courtroom for three hours

  • A prosecution witness supported perjured testimony
  • Thomas Ewing presented three sets of closing arguments; one for Samuel Arnold, one for Dr. Mudd and one against the jurisdiction of the commission
  • Mrs. Surratt was too sick to appear in the courtroom today

The Trial Today: June 22

The Trial Today: June 21

Here’s a sample of what occurred on this day in the Lincoln conspiracy trial:

  • William Doster presented his closing arguments for Lewis Powell, portraying him as having been indoctrinated by slavery, the Confederacy, and John Wilkes Booth
  • The other conspirators listened in rapt attention at the narrative of Powell’s life and even Powell’s eyes teared up for a bit at mention of his distant family
  • Doster presented his closing arguments for George Atzerodt, including his confession that he had joined a plot to abduct, not kill, the President
  • Frederick Aiken presented his closing argument for Mary Surratt, thoroughly attacking the credibility of the chief prosecution witnesses against her, Louis Weichmann and John M. Lloyd
  • Gen. Kautz, of the commissioners, described Aiken’s argument as “flowery” but “neither legal or logical”

The Trial Today: June 20

  • The prisoners started receiving daily time outdoors in the prison yard on this date
  • Thomas Ewing presented his closing arguments for Edman Spangler
  • An extension was granted to the remaining defense lawyers in order to give them time to finish their arguments

The Trial Today: June 19

Here’s a sample of what occurred on this day in the Lincoln conspiracy trial:

  • Closing arguments began on the part of the defense
  • John Clampitt read the long absent Reverdy Johnson’s argument against the jurisdiction of the commission
  • David Herold’s defense was read by one of the court reporters because his lawyer, Frederick Stone, was absent
  • Mary Surratt was overcome by the heat and was placed in the doorway of the courtroom to get more air
  • Walter Cox read his closing argument for Michael O’Laughlen which also included a defense of Samuel Arnold
  • Julia Wilbur, an anti-slavery relief worker, visited the courtroom and sketched the layout in her diary
